2) Acceptance of Terms
By accessing or purchasing from our Shopify store, you agree to these Terms and to our Privacy Policy and Return Policy. If you do not agree, do not use the site.

3) Eligibility
You must be the age of majority in your jurisdiction to purchase. If you permit a minor to use the site, you are responsible for their actions.

4) Account
You are responsible for your account credentials and all activity. Provide accurate information and keep it updated. We may suspend or terminate accounts at our discretion.

5) Products, Pricing, and Availability
Products may have limited quantities and are subject to return or exchange only as stated in our policies. We try to display colors and images accurately but cannot guarantee screen accuracy. We may change products, prices, or limits at any time.

6) Orders and Payment
Placing an order is an offer to buy. We may accept, refuse, or cancel any order, including for suspected fraud. Payments are processed through Shopify Payments or other approved processors. You authorize us and our processor to charge your payment method for the full amount, including taxes, duties, and shipping.

7) Shipping, Risk of Loss, Delivery
We ship to the destinations shown at checkout. Delivery dates are estimates, not guarantees. Risk of loss passes to you upon delivery to the carrier unless required otherwise by law.

8) Returns and Refunds (Food Products = Final Sale)

All food products are non-returnable and non-exchangeable. This does not affect your statutory rights where applicable.
Inspect your order at delivery or pickup. If you received the wrong item or there is a manufacturing defect, email contact@foodie-family.com within 48 hours with photos and your order number. Do not discard the product or packaging until we advise. If confirmed, we may replace the item or issue a refund at our discretion.

Unauthorised returns will be refused.

9) Promotions, Gifts, and Discount Codes
Promotions and codes are subject to the terms stated when issued, may be changed or withdrawn at any time, have no cash value, and are non-transferable unless expressly allowed.

10) Subscriptions (if applicable)
For subscription products, you authorize recurring charges until you cancel in your account or by contacting us at least 30 days before the next renewal. We will give notice of price changes when required.

11) Prohibited Uses
Do not use the site to violate laws; infringe IP; transmit malware; scrape, copy, or interfere with the site; circumvent security; or engage in fraud, harassment, or other harmful activity.

12) Intellectual Property
All site content, trademarks, and designs are owned by us or our licensors. You may not use, copy, or exploit them without prior written permission.

13) Third-Party Services
Our store runs on Shopify and may link to third-party sites or apps. They are provided “as is.” We are not responsible for third-party content, policies, or practices. Your use is at your own risk.

Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product at issue. Nothing in these Terms limits consumer rights that cannot be excluded by law.

16) Indemnification
You agree to indemnify and hold Food Crayon, its affiliates, and employees harmless from claims, losses, and expenses arising from your breach of these Terms or misuse of the site, to the extent permitted by law.

17) Governing Law and Jurisdiction
These Terms are governed by the laws of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You and we submit to the non-exclusive jurisdiction of the courts located in Montréal, Québec. Mandatory consumer protections in your place of residence still apply.

18) Changes to These Terms
We may update these Terms at any time by posting a new version on the site. The effective date will change. Your continued use after changes means you accept the updated Terms.
